Partition Act, 1893 — Section 4 — Pre-emption — Right of co-sharer to claim, availability, scope — Right of co-sharer to claim for pre-emption available only if a transferee files a suit for partition — Suit for partition — Alienation of certain portion of property to outsiders — Plaintiff being co-sharer claiming right of pre-emption — Not available to plaintiff in a suit brought for partition by a co-sharer but available if purchaser files suit for partition of a share in joint family property.
